New Asylum Processing Rule (7/31/2026)

  • The Trump Administration published a new rule on July 28 about how Asylum Officers should process asylum applications.
  • The rule allows Asylum Officers to transfer some asylum cases to immigration court for deportation proceedings without first interviewing the applicant. Situations in which an Asylum Officer may be able to do this include:
    • The asylum application was submitted more than 1 year after the applicant entered the US
    • The applicant has been convicted of a crime that the government considers “particularly serious” or thinks makes you a threat to public safety
    • The asylum officer decides the applicant is not eligible or merits asylum as a matter of discretion
  • If a case is transferred to immigration court, the applicant will have an opportunity to apply for asylum with the immigration judge.
