IN THE COURTS

On Friday, the 1st Circuit Court of Appeals in Boston sided with plaintiffs against the Trump Administration’s efforts to deny birthright citizenship under the 14th Amendment. The court was clear that this was not a hard decision to reach, despite the fact that the opinion was 100 pages long. This is the second federal appeals court to rule against the administration, joining the 9th Circuit which had reached a similar conclusion in July. The administration had already appealed the 9th Circuit decision to the Supreme Court with oral arguments expected in late winter or early spring with a decision likely to come out in early summer. 

Legal Groups File Emergency Motion to Stop ICE from Jailing Immigrant Teens in Adult Detention The U.S. District Court for the District of Columbia granted our emergency motion—filed in partnership with the National Immigrant Justice Center—to stop ICE from detaining unaccompanied immigrant children in adult facilities once they turn 18. This ruling enforces a permanent injunction and halts a harmful directive that would have placed newly “aged-out” youth into adult ICE detention centers. This decision is a profound victory for immigrant youth. – American Immigration Council

Lawsuit Challenges ICE’s Brutal Silencing Of Press, Protesters In Chicago Media organizations, journalists, clergy, and citizens in the Chicagoland area sued officials in President Donald Trump’s administration for systematically violating their First Amendment rights. – The Dissenter


Democracy Forward Sues Trump-Vance Administration for Withholding Recording of Border Czar Homan Accepting Cash From Undercover Agents Democracy Forward filed a lawsuit today against the U.S. Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI) after the agencies failed to comply with a Freedom of Information Act (FOIA) request seeking the release of a key recording. The requested recording reportedly captures now–White House Border Czar Tom Homan accepting a $50,000 cash payment from undercover FBI agents in September 2024 — shortly before joining the Trump-Vance Administration. – Democracy Forward

As ICE ramps up activity in Mass., this group bears witness Connected through a community group called LUCE Immigrant Justice Network of Massachusetts, activists — like the ones gathered early in the morning in Framingham — are documenting arrests throughout the state. LUCE volunteers operate a hotline and monitor social media for reports of ICE activity, then dispatch local observers to the scene. Once they get information, they report back to the larger group, and keep notes of everything they see. – WBUR

Protesters show solidarity with New Bedford father, son at ICE check-inJuan DeLeón Mayic and his son, Diego DeLeón Lucas, stood yards away from the U.S. Immigration and Customs Boston Field Office Building just before 8:30 a.m. on a chilly Tuesday morning. Mayic, 49, seemed unfazed by the prospect that lay before him as dozens of demonstrators and their signs calling on ICE to show compassion to the pair gathered in the parking lot at Burlington Mall across the street from the ICE office. The call for solidarity and support issued through emails, social media and texts the night before would become the first action of its kind during the 25th straight week of protest outside the facility. A political asylee from Guatemala with a valid U.S. work permit, Mayic told The Light he had been doing yearly check-ins since he arrived in this country. A search of criminal records at New Bedford District Court found a 2022 charge dismissed in less than a day for a miscellaneous misdemeanor of violating a municipal ordinance. – New Bedford Light

Immigration authorities ordered a Vermont man to an ICE check-in. 200 friends decided to join him.  They cheered for De La Cruz as he exited the family’s minivan, sang the national anthem, and then watched him disappear behind the federal building doors. –Vermont Public

Burlington Town Meeting votes to condemn ICE center Elected Burlington Town Meeting officials overwhelmingly voted to support a resolution focused on holding U.S. Immigration and Customs Enforcement accountable for its actions at a local processing center. The resolution decries “inhuman treatment of detainees,” as reported by formerly detained immigrants. The resolution also condemns violations of local zoning law and urges ICE to change how it’s using the facility. – WGBH

Suburban pastor’s pilgrimage to New York will highlight plight of immigrants The Rev. Gary Graf, 67, pastor of Our Lady of the Heights in Chicago Heights, said he’s on a walk to mobilize Americans toward compassion. –The Chicago Sun-Times

Pope Leo tells US bishops to address Trump’s immigration crackdown Pope Leo told U.S. bishops visiting him at the Vatican on Wednesday that they should firmly address how immigrants are being treated by President Donald Trump’s hardline policies, attendees said, in the latest push by the pontiff on the issue. – Reuters

Activists note ICE’s absence at Burlington airport in recent months After months of tracking U.S. Immigration and Customs Enforcement flights and interfering with movements of ICE officials, activists say their tactics are working. – VT Digger

Global Cities Fund Launches New $3M Investment to Advance Economic Inclusion for Migrants and Refugees This year, National Co-Op Month is particularly special for the City of Boston Mayor’s Office of Immigrant Advancement, since we are one of only six cities worldwide to be awarded the Global Cities Fund for Migrants and Refugees by The Mayors Migration Council (MMC). With this funding, Boston will launch the city’s first immigrant-led home care cooperative to serve Boston’s aging population. – Mayors Migration Council

Over 1.5 million TPS holders—many who’ve lived and worked legally in the U.S. for decades—are at risk of losing protection. These are our neighbors, coworkers, and community leaders who contribute daily to the fabric of our country. The cancellation of TPS by the Trump administration has created fear and uncertainty for countless families, threatening separation, job loss, and the loss of their home in the U.S.

We will start gathering at 5am and we will remain until 7pm. Some courageous attendees will be there the whole time, and many more will come and go as they are able.
